1. Applicability Of These Conditions
1.1 These general terms and conditions of sale (hereafter: Conditions) are applicable to all offers, (sales) agreements and deliveries of lightly, to the exclusion of any other general terms and conditions.
1.2 In these Conditions, the other party of Tamara Design Co will be referred to as the client.
1.3 The purchase conditions of the client shall not exclude or limit the applicability of these Conditions.
1.4 By accepting an offer, placing an order or entering into an agreement, the client also accepts the applicability of these Conditions.
1.5 A deviation from the provisions contained in these Conditions can only be made in writing and solely Tamara Design Co, in which case the other provisions will remain unimpaired.
1.6 All rights and claims as stipulated in these Conditions and if applicable in additional agreements for the benefit of Tamara Design Co, are likewise stipulated for the benefit of intermediaries and other third parties used by Funky Wombat Textiles.
2. Offers And Agreements
2.1 All offers and quotations made by Tamara Design Co are free of obligation and Tamara Design Co retains the express right to change the prices, in particular when this is required on the basis of (statutory) regulations. See article 3.7.
2.2 An agreement only comes into effect after written acceptance by Tamara Design Co, of the clients order. Tamara Design Co is entitled to refuse orders or attach certain conditions to the delivery, unless explicitly stipulated otherwise. If an order is not accepted, this will be communicated by Tamara Design Co within 2 working days of receiving the order.
2.3 The colours, materials, sizes and finish of all information, models and images are only intended as an indication. Minor deviations from this cannot be grounds for rejection, a discount, compensation or annulment of the agreement.
3. Prices And Payments
3.1 The prices specified on the website are in AUD ($), and inclusive of GST, they are exclusive of shipment costs.
3.2 All orders must be paid in advance without discount or compensation, unless otherwise agreed in writing.
Payment can be made as specified during the ordering process. If you are ordering more than one product we can look at combined shipping costs.
3.3 If the client defaults on any payment, Tamara Design Co, is entitled to suspend or the relevant agreement and any other associated agreements.
3.4 If the prices of the offered products and services increase during the period between the order and its execution, the client is entitled to cancel the order or dissolve the agreement within five (5) working days of being notified by Tamara Design Co, of the price increase.
4. Delivery And Receipt
4.1 The delivery times specified by Tamara Design Co, are only intended as an indication. Exceeding of a delivery time does not entitle the client to compensation, cancel the order or dissolve the agreement, unless the delivery time has been exceeded to the extent that it is no longer reasonable for the client be expected to maintain the agreement. The client is then entitled to cancel the order or dissolve the agreement, if necessary.
4.2 All fabrics meters and samples are produced ready for shipment in approx 10 working days. Wallpaper 10 working days and cushions allow up to 28 working days. If goods are in stock we can ship within 1-2 working days. They are non – bonding estimates, based upon manufacturing lead times. Delivery times of freight is in accordance with Australia Post terms of shipment. Australia orders 3-7 days , Express post 1-2 days. International orders Express Post take 3 working days from dispatch, Airfreight up to 2-3 weeks. Tamara Design Co is not responsible for third party delays.
4.3 The delivery of the products takes place at the location and time at which the products are ready for shipment to the client, irrespective of any agreement between Tamara Design Co and the client regarding the transport and, if applicable, insurance.
4.4 The client is obliged to inspect the products on delivery to determine whether they conform to the agreement. If the packaging is missing or damaged, the client must open the packaging in the presence of the conveyor and inspect the goods for damage and the client must document any damage on the delivery note and take photograph. If damage is identified that is the result of defective packaging, the client can refuse the product and return it to the conveyor. The client must provide written reasoned notification to Tamara Design Co of any (transport) damage or other deficiencies within 24 hours of delivery. The client if responsible for obtaining insurance. If the client obtains insurance from Australia post they must take damaged goods to local Australia post or international postal partner to claim damages.
4.5 If the client in cases other those referred to in the previous paragraph should refuse a delivery,Tamara Design Co can charge the resulting costs to the client. In this case Tamara Design Co is entitled to dissolve the agreement, without prejudice to their right to claim full compensation.
5. Returns Policy
Cancellation and Refunds
We have the right to cancel your order if we cannot deliver for any reason. You will receive a full refund.
Due to the specialty nature of products sold by Tamara Design Co – you are unable to cancel your order once your order has been accepted by us and credit card charged.
Due to the specialty nature of products sold by Tamara Design Co – a refund will only be given in the following circumstances, as required by the laws of ACT.
As a consumer, you are legally entitled to a refund, exchange or repair from the place of purchase if goods:
- had a fault you did not know when you bought it
- were not the same as the seller or advertisement described
- don’t match the sample you ordered of the same item

If the wallpaper is faulty what is your returns policy?
Our responsibility only applies for product faults during manufacture. Please note that you should check all wallpaper products and matching batch numbers for faults before hanging by yourself or your installer. If the product is defective in any way or has a fault, a full replacement or refund will be made at no charge prior to installation
If during the installation process, products are damaged or incorrectly installed we do not offer a refund or exchange.
All of our products come with detailed installation instructions as recommended by the manufacturer including recommended adhesive. If these instructions are not followed and a fault appears during or after installation, we do not accept any responsibility and will not offer a refund. We have recommended installers in each state and recommend installation only by professional installers. If you install, you do so at your own risk and we will not accept any responsibility for product once installed.
To determine a faulty product please send us an e-mail to Tamara@Tamaradesignco.com, stating your invoice number, date of receipt, application method and a digital image of the fault. If we agree that the product is faulty, please send to Tamara Design Co at 38 13-15 Sturt Avenue Griffith ACT 2603. Tamara Design Co will reimburse you for the cost of delivery in this instance.
Please Note: We are unable to offer a refund or accept a return unless the terms listed above are in breach. We do not refund for incorrect choice, over order or under ordered product. Please do not ask to avoid disappointment.
Overseas orders must comply with will all applicable regulations and legislations, including customs permits, import duties and taxes will be clients responsibility on arrival of goods to destination. The cost of delivery and returns is not covered by Tamara Design Co under any circumstances so therefore purchases are entirely at your own risk. It is the clients responsibility to obtain sufficient insurance for purchases.
Intellectual and industrial property rights
The client must respect completely and unconditionally the intellectual and industrial property rights attached to the products supplied by Tamara Design Co.
6.1 Other damage or damage exceeding the provisions in the previous paragraph will not be accepted by Tamara Design Co, unless there is demonstrable intent or gross negligence on the part of Tamara Design Co. If Tamara Design Co is liable in respect of the above, liability for damage as a result of loss of profit and consequential loss is expressly excluded.
6.2 The maximum liability of Tamara Design Co is always limited to the amount of the product or products that resulted in the damage.
6.3 All other damage, including loss of profit and consequential loss, resulting from non-delivery or late delivery is expressly excluded.
7. Order Processing
7.1 If the client provides an address in cart to Tamara Design Co, Tamara Design Co is entitled to send all orders to this address unless the client notifies us in writing of a different address to which the orders must be sent with two days of order.
7.2 Tamara Design Co is entitled to use third parties to execute orders.
8.1 Personal information is collected at different locations within the Tamara Design Co websites. This is carried out using electronic forms that must be completed by the client when they order a product, subscribe to a newsletter, requests information, participate in a questionnaire or competition, or use another service offered via the websites.
8.2 The personal information provided by the client via these types of forms will be stored by Tamara Design Co. These details and files will be used to be able to supply the requested products, services or information to the client. This information will not be provided to third parties unless it is directly related and unavoidable for the delivery of the requested products, services or information, such as to a conveyor.
